1. Introduction

Welcome to Tuned.ie ("the Platform"), a service dedicated to the learning and preservation of traditional Irish music. These Terms of Service ("Terms") govern your use of our website, services, and content. By accessing or using the Platform, you agree to be bound by these Terms.

2. Intellectual Property Rights

2.1. Our Content

The Platform, including its code, branding, design, and content provided by Tuned.ie, is the exclusive property of Tuned.ie and its licensors. You may not use this content without our prior written permission.

2.2. User-Generated Content (Your Music & Data)

You retain ownership of the intellectual property rights in the content you upload to the Platform, including audio recordings, notations, and profile information ("Your Content").

However, by uploading Your Content, you grant Tuned.ie a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform Your Content solely for the purpose of operating, promoting, and improving the Tuned.ie service. This allows us to make your tunes available to subscribers, feature your profile, and use your content within the functionality of the Platform.

You warrant that you own or have the necessary rights and permissions to grant this license to us and that Your Content does not infringe upon any third-party rights.

3. Content Liability and Security

You are solely responsible for Your Content and for any legal issues arising from it. While we require a user login to access content, you acknowledge that Tuned.ie is not a content protection service. We are not liable for the unauthorized use, copying, or distribution of Your Content by other users or third parties. We will, however, implement a "Notice and Takedown" procedure for valid copyright complaints as required by law.

4. User Conduct

You agree not to use the Platform to upload illegal content, harass others, infringe on intellectual property, or attempt to disrupt our services. We reserve the right to remove content and terminate accounts that violate these terms.

5. Subscriptions and Payments

Certain parts of the service are available only through paid subscriptions. Payment terms are described on our Pricing page and are processed through our third-party payment processor (Stripe). You agree to their terms of service when making a payment. For creators, revenue share terms are as agreed upon during your onboarding.

6. Disclaimer of Warranties & Limitation of Liability

The Platform is provided "as is" without any warranties. Tuned.ie is not liable for any indirect, incidental, or consequential damages arising from your use of the service.

7. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
